This Privacy Policy explains how Modern Electric, Inc. (“Modern Electric,” “we,” “us,” “our”) collects, uses, discloses, and protects information about you when you visit our websites, sign up for our waitlist or services, apply for or use our offerings, interact with our team, or use any related products, software, or devices (collectively, the “Services”).

We built Modern Electric to coordinate home energy hardware and service delivery through a network of partners. That requires collecting certain information—especially about the home, the equipment, and (if you choose) the home’s energy usage and device performance. We do not sell your personal information.

1) Scope

This Policy covers information we process when you:

  • Visit our websites or landing pages

  • Submit a form, join a waitlist, request information, or book a call

  • Create or use an account (if offered)

  • Enroll in, receive, or inquire about our Services (including installation, maintenance, monitoring, and program participation where applicable)

  • Communicate with us (email, phone, SMS, chat, social)

  • Use any Modern Electric software, mobile apps, portals, or connected device features (if offered)

This Policy does not cover third parties we do not control (e.g., installers, equipment manufacturers, lenders, payment processors, utilities, or other counterparties) when they process your information under their own privacy policies.

2) Information We Collect

We collect information in three ways: (a) you provide it, (b) we collect it automatically, and (c) we receive it from partners/third parties.

A. Information you provide

Depending on how you interact with us, you may provide:

  • Contact information: name, email, phone number, mailing address

  • Account information: login credentials, account preferences (if accounts are offered)

  • Home and project details: service address, property characteristics (as provided by you), photos you submit, equipment details, installation preferences, and related notes

  • Communications: messages you send us, call recordings (where permitted by law), support requests, and feedback

  • Marketing preferences: opt-in/opt-out status for emails and SMS

B. Information collected automatically (website/app)

When you use our websites or online Services, we may collect:

  • Device and network data: IP address, browser type, device identifiers, operating system, language, approximate location (derived from IP), referral URLs

  • Usage data: pages viewed, links clicked, time spent, error logs, and similar analytics data

  • Cookies and similar technologies: as described in Section 4

C. Information we receive from partners and third parties

To evaluate eligibility, deliver Services, and operate reliably, we may receive information from:

  • Installation, operations, and support partners: appointment status, install completion data, service tickets, maintenance notes, warranty status

  • Equipment and monitoring integrations (where enabled): inverter/battery identifiers, firmware versions, health metrics, performance events

  • Utilities or utility-data providers (where enabled/authorized): billing history, interval usage, meter data, rate plan information, outage information, and/or interconnection status

  • Payment processors: payment status and transaction metadata (we do not receive full card numbers from most processors)

  • Financing or underwriting partners (if you apply): application status and outcome; we may receive limited decisioning/eligibility signals

  • Public and commercial data sources: property records, permit records, and similar datasets used to verify address/home characteristics, reduce fraud, and improve operational planning

  • Marketing/lead sources: contact details and campaign attribution if you engage with our ads or partners

D. Energy equipment and telemetry data (when you use connected features)

If you enroll in Services that include monitoring, optimization, or performance assurance, we may collect and process:

  • Device telemetry: battery state of charge, charge/discharge rates, cycle counts, temperatures, availability, inverter status, solar production, export/import, and fault events

  • System configuration data: make/model/serial numbers, inverter/battery pairing, site settings, commissioning dates

  • Operational signals: dispatch windows, performance measurements, and verification data (including for audits or compliance where applicable)

Important: We only collect telemetry/control data to the extent necessary to provide the Service you signed up for and to meet safety, reliability, and contractual requirements.

3) How We Use Information

We use information for the following purposes:

A. Provide and operate the Services

  • Set up and administer accounts (if offered)

  • Evaluate eligibility and deliver the Services you request

  • Coordinate installation, maintenance, monitoring, and customer support

  • Provide performance insights, alerts, and reporting

  • Process payments and manage subscriptions (if applicable)

B. Safety, reliability, and security

  • Detect, prevent, and respond to fraud, abuse, and security incidents

  • Maintain the integrity and reliability of equipment monitoring and software

  • Troubleshoot and resolve issues with our Services or partner delivery

C. Improve and develop

  • Analyze usage patterns to improve our websites, products, and operations

  • Test and refine features, workflows, pricing presentation, and service delivery

D. Communications and marketing

  • Respond to inquiries and provide customer support

  • Send service-related messages (e.g., confirmations, updates, operational alerts)

  • Send marketing communications only where permitted by law or with your consent; you can opt out anytime (Section 7)

E. Legal and compliance

  • Comply with applicable laws and regulations

  • Enforce our Terms, protect our rights, and resolve disputes

  • Maintain records for tax, accounting, and audit purposes

F. De-identified / aggregated insights

We may create de-identified or aggregated datasets (that do not reasonably identify you) for analytics, forecasting, operational planning, and to evaluate program or system performance. We may share these de-identified/aggregated insights with partners or counterparties.

4) Cookies, Analytics, and Similar Technologies

We use cookies and similar technologies (e.g., pixels, SDKs) to:

  • Keep our websites functioning

  • Remember preferences

  • Understand site performance and improve user experience

  • Measure marketing effectiveness

You can control cookies through your browser settings and, where available, our cookie banner/preferences tool. Blocking certain cookies may affect site functionality.

Do Not Track: Some browsers offer “Do Not Track” signals. We do not respond to all such signals uniformly because there is no consistent industry standard.

5) How We Share Information

We share information only as necessary to operate our business, provide Services, and comply with law. We may share information with:

A. Service providers (processors)

Vendors who provide services on our behalf, such as:

  • Cloud hosting, databases, and security providers

  • Customer support tools, CRM systems, scheduling tools

  • Analytics providers

  • Email/SMS providers (for communications you request or consent to)

  • Payment processors

They may access information only to perform services for us and must protect it.

B. Installation, operations, and warranty partners

We may share relevant contact, address, project, and equipment information with contractors, service providers, or warranty/insurance administrators to deliver installation, maintenance, or support.

C. Financing and payment partners (if you apply or enroll)

If you apply for financing or payment-related services, we may share information necessary to process your request and receive status updates. The lender/financing partner will process your information under their own privacy policy.

D. Grid counterparties and program administrators (where applicable)

If you choose to participate in programs or services involving external counterparties (e.g., utility coordination, performance verification, or related arrangements), we may share the minimum necessary information to:

  • Verify performance or availability

  • Support settlement, auditing, or compliance obligations

  • Operate program enrollment and reporting

Where feasible, we favor aggregated or de-identified reporting.

E. Legal, safety, and business transfers

We may disclose information:

  • To comply with law, legal process, or regulatory requests

  • To protect rights, safety, and security of Modern Electric, our users, partners, or others

  • In connection with a merger, acquisition, financing, reorganization, or sale of assets (information may be transferred as part of that transaction, subject to appropriate safeguards)

6) Data Security

We use administrative, technical, and physical safeguards designed to protect information from unauthorized access, loss, misuse, alteration, or disclosure. No system is 100% secure; you are responsible for keeping your credentials confidential and notifying us promptly of any suspected unauthorized access.

7) Your Choices and Rights

A. Marketing preferences

  • Email: You can unsubscribe using the link in our emails.

  • SMS: You can reply STOP (or follow instructions provided in the message).

  • You may also contact us to opt out (Section 12).

B. Access, correction, deletion

Depending on your location and applicable law, you may have rights to:

  • Access the personal information we maintain about you

  • Correct inaccurate information

  • Delete certain information

  • Obtain a copy of your information (portability)

  • Object to or restrict certain processing

We may need to verify your identity before fulfilling requests, and we may retain certain information as required for legal, security, or operational purposes.

C. U.S. state privacy notices (CA/CO/CT/VA/TX and others)

If you are a resident of a state with privacy rights, you may have the right to:

  • Know the categories of personal information collected, used, and disclosed

  • Opt out of “targeted advertising” or certain data sharing (as defined by state law)

  • Appeal a denial of your request (where required)

We do not sell your personal information.
We may share limited data with analytics/advertising partners for measuring campaign performance. Where required by law, we offer opt-out mechanisms for certain types of targeted advertising.

8) Data Retention

We retain personal information as long as reasonably necessary to:

  • Provide the Services

  • Maintain business records

  • Meet legal, regulatory, tax, accounting, and audit requirements

  • Resolve disputes and enforce agreements

  • Protect against fraud and abuse

Retention periods vary depending on the type of information and why we collected it.

9) Children’s Privacy

Our Services are not directed to children under 13 (or under 16 in certain jurisdictions), and we do not knowingly collect personal information from children. If you believe a child has provided personal information to us, contact us and we will take appropriate steps.

10) External Links

Our websites may link to third-party sites or services. We are not responsible for their privacy practices. Please review third-party policies before providing information to them.

11) Changes to This Policy

We may update this Policy from time to time. If we make material changes, we will update the Effective Date and provide notice as required (e.g., via the website or email). Your continued use of the Services after an update means you accept the revised Policy to the extent permitted by law.
